This appeal has been filed under Section 14A (2) of SC/ST Act against the order dated 20/12/2016 passed by the Special Judge, SC/ST Act Cases, Jaipur whereby the anticipatory bail application filed by the appellant has been dismissed.

Brief facts of the case are that an FIR No. 430/2016 was registered at P.S. Pragpura, Jaipur for the offences mentioned therein. On apprehending his arrest, he moved antidicpatory bail application before the trial court, who vide impugned order dismissed the same. Hence this appeal has been filed on behalf of the appellant.

Learned counsel for the appellant/s has contended that the accused appellant/s has/have been falsely implicated in this case. Hence, he/she/they should be released on bail.

Learned PP has opposed the same.

In view of above, without expressing any opinion on the merits and demerits of the case, I deem it just and proper to quash and set aside the order dated 20/12/2016 and grant anticipatory bail to the appellant.

Therefore, this Appeal filed under Section 14 A (2) of SC/ST Act is allowed and it is directed that in the event of arrest of appellant Prakash Singh son of Shri Ram

Singh in aforesaid FIR, he shall be released on bail by the concerned SHO/Investigating Officer, provided he/she/they furnish(es) a personal bond in the sum of Rs. 2,00,000/(Rs. Two Lakh), with two sureties of Rs. 1,00,000/ (Rs. One Lakh) to his/her satisfaction on the following conditions:

i) That the appellant(s) shall make himself/themselves available for interrogation by a police officer, as and when required;

ii) That the appellant(s) shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the court or to any police officer;

iii) That the appellant(s) shall not leave india without previous permission of the court;
