This writ petition (Parole) has been filed with the following prayer:

“It is therefore humbly prayed that your lordship may graciously be pleased to accept this writ petition and may be pleased to order the release of the accused petitioner Sashrath singh on second parole for 30 days.”

Learned counsel for the petitioner has contended that the petitioner has completed the sentence of 7 years 3 months and 6 days approximately, hence he should be granted 30 days parole.

I have heard learned counsel for the parties and carefully perused the relevant material on record.

I am satisfied with the contents mentioned by the petitioner in his writ petition (Parole), although Mr.BN Sandu, AAG for the State has opposed the same.

For the reasons, the writ petition (parole) filed on behalf of the petitioner Dashrath Singh son of Pyare Lal is allowed and he is ordered to be released on second parole for 30 days, provided he furnishes a personal bond of Rs.5,00,000/- (rupees five lacs) with two sureties of Rs.2,50,000/- (rupees two lacs fifty thousand) each to the satisfaction of the Distt. Magistrate, Karauli with the following directions:

(i) He will not commit any offence during the parole period of 30 days. (ii) He will surrender before the jail authorities/court concerned immediately on completion of parole period of 30 days.

(iii) If the petitioner commits any offence during the period of parole period or does not surrender before the jail authorities/court concerned on completion of parole period, the concerned authorities will be free to take action against him in accordance with law.

(iv) The petitioner will appear before the concerned police station once in a week during the parole period.

(v)The aforesaid parole period will include the time to be taken during journey.

¶16

(vi)The parole period of 30 days will be counted from the date of release of the petitioner from the jail concerned.

(vi)The concerned magistrate is directed to send a copy of this order to the concerned SHO for necessary compliance.
