बहस उभय प्ष सुनी गई एवं स�पूणर् प्ऴावली का �यानपूवर्क अवलोकन िकया गया। तदुउपरा�त इस �यायालय का करण के त�य� और िविन�य यह है िक वतर्मान ्ऺ पिरि�थितय� म� जबिक अिभयु्व गण के िव�्ध प्ऴावली पर उपल�ध सा�य� के आधार पर ्ऺथम��या यह पाया गया िक अिभयु्व गण को पुिलस अिधकािरय� के ्षारा नामजद होते हुए भी ्ऺकरण म� संिल� नहीं माना गया था जबिक �यायालय के सम्ष सा�य म� इनकी संिल�ता होना ्ऺथम ��या पाया गया

है और उसके उपरा�त िववेचना�मक आदेश िदनांक 30.03.2015 को पािरत करते हुये इ�ह� अिभयु्व गण कहा जाकर्ऺ ान िलया जाकर िगर�तारी वार�ट से तलब करने का सं्ञ आदेश िदया गया है। ्ऺकरण म� अिभयु्व गण के िव�्ध आ्षेप अ�यिधक ग�भीर ्ऺ कृित के है। ्ऺ करण के गुणावगुण पर िकसी भी ्ऺकार की कोई िट�पणी िकया जाना उिचत ्ऺतीत नहीं होता है। यह स�य है िक इस �यायालय के आदेश के िव�्ध माननीय उ�च �यायालय म� यािचका ्ऺ�तुत की गई थी और माननीय उ�च �यायालय ने इस �यायालय के आदेश को उिचत माना है और उसम� िकसी ्ऺकार का कोई पिरवतर्न नहीं िकया है। ऐसी दशा म� �प� है िक माननीय उ�च �यायालयने इस ्ऺकरण को धारा 438 द�ड ्ऺि्वया संिहता की पिरिध का गण को िगर�तारी से तलब िकये नहीं माना है और अिभयु्व जाने के आदेश को स�पु� िकया है। ऐसी दशा म� इस �यायालय के िवन्ा मत म� जबिक माननीय उ�च �यायालय गण को िगर�तारी वार�ट के आदेश को के ्ष ारा अिभयु्व आदेश के िवपरीत कोई स�पु� िकया जा चुका है तो िफर उ्व आदेश पािरत करना और िगर�तारी वार�ट को जमानत वार�ट या स�मन म� पिरवितर्त करना �याियक ्ऺित�थापना के िव�्ध होगा। जहां तक धारा 438 द 0 0 सं0 के ्ऺावधान� का ्ऺ� है। इस �यायालय के िवन्ा मत म� धारा 438 द 0 0 सं0 के्ऺ गण को जमानत का लाभ ावधान� के अ�तगर्त अिभयु्व सामा�यत: अनुसंधान की ्ऺि्वया के दौरान िदया जाता है और गण वह भी तब �यायालय को यह ्ऺतीत होता हो िक अिभयु्व के िव�्ध लगाये गये आ्षेप ्ऺथम ��या ही िनराधार है और

ऐसे आरोप उसकी ्ऺ ित�ा को ्ष ित पहुंचाने के िलए लगाये गये है। यह ्ऺकरण इस �यायालय के िवन्ा मत म� धारा 438 द 0 गण के 0 सं0 की पिरिध म� नहीं आता है जबिक अिभयु्व िव�्ध प्ऴावली पर उपल�ध सा�य से ्ऺाथिमक �प से ्ऺकरण ान िलया जाकर बनना पाये जाने के बाद उनके िव�्ध ्ऺसं्ञ उ�ह� िगर�तारी वार�ट से तलब िकया है जो िक ह�या जैसे गण को ग�भीर अपराध से संबंिधत है। ऐसी दशा म� अिभयु्व अि्षम जमानत का लाभ िदया जाना �यायोिचत ्ऺतीत नहीं होता है।

अत: इस �टेज पर ्ऺ करण के गुणवगुण पर कोई िट�पणी िकये िबना मामले के सम�त त�य�, पिरि�थितय� एवं आरोप� की ग�भीरता को �यान म� रखते हुये ्ऺाथर्गण / दान िकया अिभयु्व गण को अि्षम जमानत की सुिवधा ्ऺ जाना �यायोिचत ्ऺतीत नहीं होता है।"
