This is second bail application filed under Section 439 Cr.P.C.
for grant of regular bail to the petitioner.
Petitioner had earlier approached this Court by filing S.B. Criminal Misc. Bail Application No.7200/2016. This Court on 03.06.2016 declined the prayer for grant of bail to the petitioner by passing the following order:-
“Present bail application has been filed under Section 439 Cr.P.C. for grant of a regular bail to the petitioner in a case arising out of FIR No. 229/2016, registered at Police Station Railway Colony, Kota, for the offences under Sections 354 IPC and Section 7/8 of POCSO Act.
The petitioner being a neighbour sexually exploited a child aged eight years. The cases of abuse of child by persons having fiduciary relationship are on rise.
Taking totality of circumstances, no ground is made to grant bail to the petitioner and hence, the present bail application being devoid of merit is dismissed.
No ground is made to vary the earlier order. Hence, present
petition is dismissed.
