Kishan Chand and advised to have treatment from All India Institute of Medical Sciences, New Delhi. As per the respondent petitioner she approached to All India Institute of Medical Sciences, New Delhi for immediate treatment of her husband but appointment was not accorded to her on an early date. Being desirous to immediate treatment the respondent petitioner and her other relatives considered it appropriate to carry Shri Kishan Chand to Bombay Hospital, Mumbai for necessary treatment. Suffice to mention that the hospital aforesaid is also a hospital recognised by the State of Rajasthan as per provisions of Rajasthan Civil Services (Medical Attendance) Rules, 1970. Shri Kishan Chand was admitted to Intensive Care Unit at Bombay Hospital and was diagnosed with the ailment of pulmonary embolism and tubercular vertebral collapse at various levels. He was kept on ventilator for a period of about three months but ultimately he died on 28.3.2005. After death of Shri Kishan Chand the respondent petitioner claimed for reimbursement of medical expenses in a tune of Rs.6,98,000/-. The State Government allowed a sum of Rs.2,67,478/- which would have been incurred in treatment if Shri Kishan Chand would have been availed at All India Institute of Medical Sciences, New Delhi. Being aggrieved by denial for reimbursement of complete medical expenses the respondent petitioner preferred a petition for writ before this Court that came to be accepted by this Court by judgment impugned.
