The bonus marks are awarded as 5,10, and 15 as per the length of service. The last date for filling the application form as per the advertisement was fixed as 1.4.2013. Admittedly, it is not necessary to have the experience for the eligibility to the post of Nurse Gr.II. Only, benefit of bonus marks is awarded. Thus, no fault can be found with the cut off date fixed as 28.2.2013 as the last date for counting the experience because a candidate who fills the form on the last date will stand to gain vis.a.vis. a candidate who fills the form immediately after the date of the advertisement. The cut off date applies to all candidates without any exception. Therefore, no arbitrariness or discrimination can be alleged. In fact, it safeguards against the chances of discrimination in counting the experience between candidates filling their forms on different dates between 28.2.2013 to 1.4.2013. Since all candidates are placed on the same pedestal, no grievance or prejudice is caused to any particular candidate vis.a.vis. other candidates. Thus, there is no rational in the argument of the learned counsel for the petitioner that the cut of date of counting experience should be the same as the date of acquiring the qualification.
