By t h e Cou r t :-

1 . The petitioner by way of present petition, had sought direction against the respondents to hold the election of works committee as per the provisions of the Industrial Disputes Act, 1947 (hereinafter referred to as “the said Act”) and the Rules made thereunder, being aggrieved by the communication dated 02.11.2013 (Annexure/ 3) issued by the respondent No.5. It appears that this Court vide the order dated 06.12.2013 had directed that the result of the election of the works committee, if held in the meantime, shall be subject to final outcome of the writ petition.

2 . It is submitted by the learned counsels for the parties, that under the guise of the said interim order, no elections have been held till this date, muchless pursuant to the impugned communication dated 02.11.2013.

3 . In view of the above, the very basis on which the petition was filed, has not been acted upon and no elections of the works committee have been held, pursuant to the said impugned communication. Hence, as such the petition has become infructuous. However, it is directed that the respondent/ s shall hold the election of the works committee strictly in accordance with law, and as per the provisions of the said Act and the Rules made thereunder.

4 . Subject to the aforestated observations and directions, the petition is disposed of. By this order, the stay application and other pending application if any, also stand disposed of.
