By way of this writ petition, the petitioners have questioned the legality of order dated 16.12.14 issued by the Principal, Government Physical Education College, Jodhpur, whereby the petitioners are informed that the graduation degree acquired by them from Sikkim Manipal University is not recognized and therefore, they may not be permitted to appear in the examination.
On 24.2.15, while issuing notices to the
respondents, an interim order was passed by this Court in favour of the petitioners in the following terms:-
“In the meanwhile and until further orders, the rejection of the petitioners' examination forms by the respondents shall remain stayed and the respondents are directed to permit the petitioners to appear in the B.P.Ed. Examinations scheduled to be held from 28.2.2015 provisionally. However, the petitioners' result shall not be declared. It is made clear that passing of the interim order will not create any right or equity in favour of the petitioners.”
Pursuant to the interim order passed by this
Court, the petitioners have already appeared in the examination.
A reply to the writ petition has been filed on

behalf of the respondent No.3-University of Rajasthan taking the stand that the matter with regard to recognition of the degrees issued by the Sikkim Manipal University was pending consideration before the respondent University and after due consideration, the University has already taken decision to recognize the degrees issued by the Sikkim Manipal University and therefore, the grievance raised by the petitioners does not survive for consideration of this
Court.
Learned counsel appearing for the respondent University submitted that since the petitioners have already appeared in the examination pursuant to the interim order passed by this Court, their result shall be declared by the University.
In this view of the matter, the writ petition is disposed of with the directions to the respondent University to declare the result of the petitioners of B.P.Ed. Examinations wherein they appeared pursuant to the interim order dated 24.2.15 passed by this Court, within a period of two weeks from the date of receipt of certified copy of this order.
