It is may be observed that during pendency of this appeal respondent Nos. 1 & 2 expired and their legal representatives have not been taken on record within the stipulated period of 90 days, therefore, the appeal stands abated against respondents No.1 & 2.
However, acceding to the prayer of the learned counsel for the appellant, instant appeal is dismissed as withdrawn. Office is directed to pass appropriate orders for refund of court fee tendered by the appellant with this appeal.
