Learned counsel for both the parties submit that issue involved in the present writ petition has already been decided by this Court in the case of S.G.Rao & Ors. Vs. State in SB Civil Writ Petition No.5680/1996. An appeal preferred by the respondent/s before the Division Bench is still pending. In view of above, a prayer is made to cover this writ petition by the judgment in case supra. Both the parties have agreed to abide by the final outcome of the special appeal pending before the Division Bench or further judgment by the Apex Court, if any of the parties approach the Apex Court after decision in the special appeal.
In view of prayer made, this writ petition is allowed and is ordered to be governed by the judgment in the case of S.G.Rao & ors. (supra). However, both the parties would abide by the final outcome of the special appeal pending before the Division Bench and even further judgment, if appeal is preferred before the Apex Court by any of the parties.
