ाथर् ्षारा यह जमानत का ्ऺाथर्ना प्ऴ द�ड ्ऺि्वया संिहता की धारा-439 के अ�तगर्त ्ऺ�तुत कर उसे जमानत पर �वतं्ऴ िकये जाने की ्ऺाथर्ना की गई है।
िव्षान अिधव्व ा ्ऺ ाथर् का तकर् है िक ्ऺ ाथर् के िव�्ध धारा19/54, आबकारी अिधिनयम के आरोप है, जो ्ऺथम �ेणी द�डनायक्ष ारा िवचारण योग्य है। उनका यह भी तकर् है िक ्ऺाथर् लगभग एक माह से �याियक अिभर्षा म� है तथा ्ऺकरण का िन�तारण होने म� समय लगना स�भािवत है। अत: ्ऺाथर् को जमानत पर �वतं्ऴ िकया जावे।
लोक अिभयोजक ने जमानत ्ऺाथर्ना प्ऴ का िवरोध िकया।्ऺ
करण के सम्ष त�य� एवं पिरि�थितय� पर �ि�पात करने के कार का कोई मत उपरा�त,्ऺकरण के गुणावगुण पर िकसी ्ऺ अिभ�य्व िकये िबना िवशेषत: इस त�य को म�यनजर रखते हुए िक्ऺ ाथर् के िव�्ध धारा-19/54, आबकारी अिधिनयम के आरोप है जो्ऺ थम �ेणी द�डनायक ्ष ारा िवचारण योग्य है,म� ्ऺ करण म� द�ड्ऺ ि्वया संिहता की धारा-439 के ्ऺावधान आकिषर्त करते हुए ्ऺाथर् को समुिचत जमानत रािश पर जमानत की सुिवधा ्ऺदान िकया जाना उिचत समझता हूं।
पिरणामत: ्ऺाथर् ्षारा ्ऺ�तुत यह जमानत ्ऺाथर्ना प्ऴ �वीकार

िकया जाता है तथा आदेश िदया जाता है िक यिद ्ऺ ाथर् जेठान�द पु्ऴ दौलत राम (हाल- ब�दी के�्शीय कारागृह,जयपुर) िवचारण �यायालय के संतोष अनुसार 50,000/-�पये (अ्षरे पचास हजार) का �यि्व गत ब�ध प्ऴ व 25,000/-�पये (अ्षरे प�चीस हजार) रािश की दो सु�ड़ एवं िव�सनीय ्ऺितभूित इस आशय की ्ऺ�तुत कर दे िक वह ्ऺकरण के िवचारण के दौरान ्ऺ�येक तारीख पेशी पर िवचारण �यायालय के सम्ष उपि�थत होता रहेगा एवं यिद ्ऺाथर् अ�य िकसी्ऺ करण म� वांिछत न हो तो उसे आर्षी के�्श ,संजय सिकर्ल, जयपुर (उ�र), जयपुर पर पंजीब्ध ्ऺाथिमकी संख्या-132/2014 से स�बि�धत्ऺ करण म� अिवल�ब जमानत पर �वतं्ऴ कर िदया जावे।
