This IInd bail application has been filed under Section 439 CrPC.

Learned counsel for the petitioner has contended that previously the bail application filed on behalf of the petitioner was dismissed as withdrawn with liberty to file a fresh bail application before the trial court after filing the challan. He has further contended that after investigation, the police has filed the challan and there is no injury against the accused petitioner, which is sufficient to cause death in the ordinary course of nature. There is only one case pending against the accused petitioner. He has further contended that the petitioner has been falsely implicated in this matter and he is in judicial lock up since long and conclusion of trial will take time, hence he should be released on bail.

Learned PP has opposed the same.

In view of above, without expressing any opinion on the merits and demerits of the case, I deem just and proper to enlarge the petitioner on bail.

Therefore, this IInd bail application is allowed and it is directed that accused petitioner Sonu @ Gulab Singh S/o Atar Singh shall be released on bail under Section 439 CrPC in connection with FIR No. 159/2013 registered at Police Station, Rajakhera, District Dholpur, provided he furnishes a personal bond of Rs. 1,00,000/- (Rs. One Lakh) with two sureties of Rs. 50,000/- (Rs. Fifty Thousand) each to the satisfaction of the trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
