Manak Chand Vs Badar Lal and Ors.

1. The petitioner-defendant, Manak Chand S/o Hansraj, has preferred this writ petition assailing the impugned order dated 10.03.2011 passed by learned Additional District Judge (Fast Track) No.1, Pali in Appeal No.1/2011, whereby the appeal filed by the respondents-plaintiffs came to be allowed and ad-interim injunction was granted.

After hearing both the learned counsel for the parties, this writ petition can be disposed of under Article 227 of the Constitution of India by directing the learned trial court to decide the pending suit itself expeditiously and till the disposal of the suit, the interim order granted by this Court on 24.02.2012 while admitting the writ petition in the following terms “ However, till then, the operation of

the impugned order passed by the appellate Court on 10.3.2011 shall remain stayed and the construction if any raised by the defendants shall be subject to final decision of the suit filed by the respondents ”, shall continue.

3. In the result, the writ petition is disposed of accordingly. No costs. A copy of this order be sent to the concerned parties and the learned trial court below forthwith.
