1. Heard learned counsel for the parties.

¶15

2. The present writ petition arises out of interlocutory order

dated 01.03.2011 passed by the Revenue Appellate Authority under Section 212 of the Rajasthan Tenancy Act, 1955, appointing the Receiver and the Board of Revenue by the impugned order Annex.10 dated 14.11.2007 has imposed a condition of depositing the security of Rs.500/- per Bigha/year. Being aggrieved by the said orders, the petitioners have approached this Court.

3. While admitting this writ petition, a coordinate bench of this Court had granted the following interim order dated 03.01.2008: -

“In the meanwhile, effect and operation of the impugned order dated 14^th November, 2007, passed by the

Board of Revenue, Rajasthan, Ajmer shall remain stayed till next date of hearing.”

4. The aforesaid interim order was later on confirmed by another coordinate bench of this Court vide the order dated 15.10.2008.

Having heard the learned counsel for the parties at some length, this Court is of the opinion that the present writ petition can be disposed of by directing the learned revenue court of S.D.O., Shapura, District: Bhilwara to decide the pending Revenue Suit No.104/1976- Banshi Lal Vs. Bahadur Singh & Ors. itself, expeditiously, preferably within a period of one year from today; and till the decision of the said suit, the interim order granted by this Court, shall continue.

6. Accordingly, the writ petition is disposed of. No costs. A copy of this order be sent to the concerned parties and the revenue courts below forthwith.
