This appeal has been filed against the judgment dated 22nd December, 2006 passed by Additional District & Sessions Judge (Fast Track) Baran in Sessions Case No. 17/2006, whereby the learned trial court convicted the accused appellant for the offence under Sections 304 Part – II IPC and Section 39 of the Indian Electricity Act,1910 and sentenced him to undergo for 7 years rigorous imprisonment with fine of Rs. 10,000/-; in default of payment of fine, to further undergo 2 years' simple imprisonment for the offence under Section 304 Part II IPC; and one year's rigorous imprisonment with fine of Rs. 5000/-; in default of payment of fine, to further undergo three months' simple imprisonment for the offence under Section 39 of Indian Electricity Act, 1910 respectively.
