Application under Section 5 of the Limitation Act is allowed for the reasons mentioned therein and the delay of 71 days in filing the appeal is condoned.
This application for suspension of sentence has been filed by the applicant.
Learned counsel for the applicant has contended that applicant's sister is going to be married on 7th May, 2013 i.e. tomorrow, hence he should be released on interim bail for one month.
Learned Public Prosecutor opposed the aforesaid contentions of the accused applicant.
Having heard the learned counsel appearing for the respective parties and carefully scanned the entire material available on record, on humanitarian ground, I deem it fit and proper to release the accused applicant on interim bail.
For the aforesaid reason, the application for interim bail filed on behalf of the accused applicant is allowed and the accused applicant is ordered to be released on interim bail on following conditions:
