It is a petition filed by local resident of Ward No.15, Near Municipal Board, Post Losal, District Sikar. His grievance is that the Board of Revenue directed the District Collector, Sikar to make a survey and submit its report regarding creation of Sub-Tehsils and the District Collector, Sikar, after survey, sent its positive report to the Board of Revenue dt.22/03/2012 for creation of Losal & Ajeetgarh as Sub-Tehsil of Tehsil Danta Ram Garh/Sri Madhpur, however, the Board of Revenue declined to create and constitute Losal as Sub Tehsil vide impugned order dt. 28/03/2012 but at the same time Ajeetgarh has been created as as Sub-Tehsil by the State Government and no reason has been assigned for adopting two different standards and that requires interference by this Court.

It may not be appropriate for this Court to express any opinion since it is the subject matter to be examined by the State Government regarding creation of Sub-Tehsil looking to

the various ancillary factors which the Government is supposed to look into and taking note thereof, this Court considers it appropriate to grants liberty to the petitioner to make representation giving complete details regarding creation of Losal as Sub-Tehsil and if such representation is made, it is expected from the State Government to examine independently taking note of the Collector's report and other material and take fresh decision in accordance with law within a period of three months of submission of such representation.

With these observations/directions, the writ petition stands disposed of.
