Instant petition has been filed by the petitioner with the grievance that he is a student of BA (Hons) a undergraduate degree course of three years, however, he could not clear the subject paper of BA (Hons)Part-II (1004-Elementary Computer) and 1107-French-2) and later appeared in BA (Hons) Part II examination in which he qualified all the papers and appeared in BA Part-III Examination-2012 under the interim order of the Court dt. 19/03/2012.

Counsel for petitioner submits that the petitioner appeared in BA (Hons) Part III along with due papers of BA (Hons) Part II (1004-Elementary Computer) and 1107-French-2) but his result has been withheld by the respondents primarily on the premise that the petitioner appeared in all the papers of BA (Hons) Part-II and BA (Hons) Part III in 2012 and that in is not permissible.

Counsel submits that the petitioner appeared in BA (Hons) Part II Examination-2011 but two papers remained due for which he

submitted application for revaluation but the result was awaited and he was advised to appear in all the papers of BA (Hons) Part II Examination and only under this bonafide belief he appeared in all the papers of BA (Hons) Part II Examination but that is of 2011 and in these circumstances, the impediment, which has been pointed out by the respondentUniversity, at least may not come in his way.

No other impediment has been pointed out by the respondents under the University Ordinance which can deprive the petitioner from declaration of the result of examination in which he appeared under the interim order of the Court.

In these facts and circumstances, the instant petition is disposed of with direction to the respondents to declare result of BA (Hons) Part III Examination-2012 of the petitioner in which he appeared under the interim order of the Court dt. 19/03/2012 and the result of the petitioner of BA (Hons) Part-II of the subject paper (1004-Elementary Computer) and 1107-French-2) may also be declared and mark sheet accordingly be issued to him within ten days of the certified copy of this order being furnished in their office.
