Instant petition came to be filed with the grievance that the petitioner despite being eligible was not permitted to write MCAPart-VI Examination on the premise that he failed to qualify two subjects of MCA-Part-V.

Counsel for petitioner submits that he was permitted to appear in MCA-Part-VI examination under the interim order of the Court dt.24.09.2010 and during pendency of proceedings he has qualified both the two subject papers of MCA-Part-V-Examination-2010 held in March,2011 and mark-sheet issued from the office of respondent-University of Raj. dt.29.07.2011 has been placed for perusal and further submits that in the light of later development which has taken place the petitioner certainly in terms of the order of the Court (supra) is entitled to seek indulgence for declaration of his result of MCA-Part-VI Examination-2010 in which he appeared under the interim order of the Court.

In view of the earlier impediment of the respondent-University being ruled out of

qualifying the papers of MCA-Part-VExamination, reference of which has been made (supra), instant petition deserves acceptance.

Accordingly, the writ petition succeeds and is hereby allowed. The respondents are directed to declare result of the petitioner of MCA-Part-VI Examination taking note of his project report of MCA-PartVI Examination which he submitted pursuant to interim order of the Court dt.24.09.2010 and final degree/mark-sheet of MCA Course may be issued to him if stands qualified.
