Heard counsel for the petitioners.

Since in all the above three writ petitions relate to similar grievance of the petitioners regarding their posting ignoring their merit position and similar relief has been sought for by the petitioners, the same are heard together and are being decided by this common order.

Earlier in identical matter of Mahesh Kumar (S.B. Civil Writ Petition No.16415/2011 this Court after hearing counsel for the petitioner therein observed that the matter of posting is a policy decision which has to be taken by the respondents only and it was further expected of them to look into the matter and see that postings of all the candidates are given without voice of arbitrariness and a policy decision be taken at the earliest to avoid such an event. Further directions have been issued for filing of representation and taking decision.

The present cases are identical to the cases of Teacher

Gr.II which are covered by the said order. The relevant portion

of the said order reads thus:-

“Since it is matter of posting, a policy decision on the aforesaid has to be taken by the respondents only. Looking to the aforesaid, the petitioner is directed to make a detailed representation to the respondents within a period of seven days from today. The respondents are then expected to look into the matter and see that postings of all the candidates are given without voice of arbitrariness and a policy decision be taken to avoid such an event. They are expected to take decision at the earliest. The petitioner may, however, join the post at the place where they are posted. It will, however, not effect his representation, rather respondents are expected to consider the representation and take a policy decision so that no discrimination remains in their action. The exercise aforesaid may be undertaken within a period of 15 days from the date of receipt of the representation and a policy decision taken thereupon be informed to the petitioner with a copy to this court to see its fairness.

With the aforesaid, the writ petition is disposed of. This disposes of stay application also.”

In view of the above, the petitioners are also entitled for the same relief and are directed to make detailed representations to the respondents within a period of seven days from today and the respondents are directed to take the decision within 15 days from the date of receipt of the representations with a copy of the decision to each of the petitioners.

With the aforesaid observation, both the writ petitions are disposed of.
