(1) By this writ petition, the petitioner is seeking an appropriate writ, order or direction to consider his experience certificate (Anx.3) which is duly countersigned by the Additional Distt. Education Officer-cum-Block Elementary Education Officer, Panchayat Samiti, Sawai Madhopur for the purpose of appointment of the petitioner to the post of Prabodhak.

(2) Submission of counsel for the petitioner is that in the experience certificate (Anx.3), issued by the Principal, Vishwakarma Adarsh Vidyapeeth, Kustala, Sawai Madhopur, which is duly countersigned by the Additional Distt. Education Officer-cum-Block Elementary Education Officer, Panchayat Samiti, Sawai Madhopur, his experience has been shown as 5 years 10 months as on 30.4.2002. However, the respondents have not selected the petitioner vide order dated 13.4.2011 (Anx.4) wherein his name has been shown at Sl.No.32 in the category of 'insufficient experience'.

(3) Counsel further submits that the petitioner served the respondents with notice of demand for justice dated 1.3.2012

(Anx.7) wherein it was stated that although the School – Vishwakarma Adarsh Vidhya Peeth, Kustala, Sawaimadhopur - had been closed on account of the death of its owner but still the record is available with the office of Addl.Distt.Education Officer cum Block Elementary Education Officer, Panchayat Samiti, Sawaimadhopur. Counsel then submits that the aforesaid notice of demand for justice dated 1.3.2012 is still pending before the respondents and further, the petitioner may be allowed to submit fresh representation to the respondents.

(4) The aforesaid request is reasonable.

(5) In case the petitioner submits fresh representation to the respondents along with copy of the notice of demand for justice and a copy of this order, within a period of one month from the date of receipt of certified copy of this order, the respondents are directed to decide the same by a reasoned order, after verifying the experience from the record of the school available with the Addl. Distt. Education Officer cum Block Elementary Education Officer, within a period of two months from the date of its receipt. In case as a result of verification, the teaching certificate of the petitioner is found to be genuine, then the petitioner's case be processed and he be given appointment as per his merit with actual benefit of seniority and notional benefit of fixation.
