(1) By this writ petition, the petitioner has challenged the scaling formula being applied by the respondents to the recruitment under the Rajasthan Police Subordinate Service Rules, 1989 (in short ` the Rules of 1989') and has sought a direction to the respondents to prepare the list of the candidates of the S.I. Examination, 2007 as per the Rules of 1989 and to appoint the petitioner on the post of Sub Inspector (AP) or Platoon Commander (RAC) as per his merit, if he is found suitable on the basis of his raw marks.

(2) Submission of counsel for the petitioner is that after the judgment dated 20.9.2011 rendered by the Principal Seat of this Court at Jodhpur in SBCWP No.3705/ 2009 and four other connected writ petitions, scaling formula has been dropped in the present examination and a fresh merit list is prepared. Counsel further submits that similar controversy has been decided by this Court in SBCWP No.3122/ 2012 Rajesh Kumar V. State of Rajasthan and others decided on 6.3.2012, after hearing counsel for the petitioner. The aforesaid judgment and order dated 6.3.2012 is as under:

“Counsel submits that the controversy involved in this case is squarely covered by the judgment rendered by the Principal Seat at Jodhpur in Ram Narayan Vs. State and Anr. : SBCWP No.3705/ 2009 and four other connected writ petitions decided vide order dated 20.9.2011, wherein it was directed that petitioners if selected, they shall be treated as the recruits against the vacancy year pertaining to the advertisement dated 9.4.2007 and their seniority shall be reckoned accordingly. On similar prayer, SBCWP No.10409/ 2010 (Dinesh Lakhawat Vs. State and ors.) filed at the Jaipur Bench Jaipur was also disposed of vide order dated 9.11.2011.

Having regard to the facts afore-stated, I require the petitioner to submit a representation to the respondent-Secretary RPSC, who shall consider and decide the representation of the petitioner within a period of six weeks from the date of submission of representation along with copy of this order before respondent No.4.

With that direction, the writ petition is disposed of.”

(3) The petitioner is also entitled for the same relief for which he may file a representation to the respondent-RPSC, who shall consider and decide the same within a period of six weeks from the date of its submission along with copy of this order before respondent No.4RPSC.
