Instant company petition U/s 439 read with 433 & 434 of the Companies Act,1956 came to be filed for winding up of the respondent company. However, by the tireless efforts of the lawyers appearing for respective parties and with the assistance of trained mediator Mr. Mathur the parties have arrived to an amicable solution of their dispute through process of mediation and the terms thereof is on record which were taken note of by this Court in its order dt.26.07.2012.
It has been informed that as per the terms of settlement arrived at between the parties the last payment is scheduled to be made on 15.01.2014 and the payments earlier became due have been honoured by the respondent and taking note thereof under these circumstances this Court considers it appropriate that the present company petition may be consigned to record.
Consequently, the instant company petition stands consigned to record. However, the parties will be at liberty to file application if occasion arises in future.
