By way of the instant writ petition, the petitioner has impugned the order dated 28^th July, 2009, whereby the learned Civil Judge (Jr. Division), Thanagaji, District Alwar did not allow the plaintiff-petitioner to produce the affidavits of other witnesses.

Having heard the submissions made by the learned counsel for the petitioner and carefully perused the impugned order and especially the order of this Court recorded on 13^th January, 2010, it is found that this Court while issuing the notices to the respondents, had already directed the plaintiff-petitioner to file the affidavits of all the witnesses, on whom he relied upon. Pursuant to the order of this Court, the plaintiff-petitioner filed the affidavits before the learned trial court on 30^th January, 2010, which is evinced from the order sheet recorded by the trial court. What relief intended to have sought for from this Court has already been granted by this Court on 13^th January, 2010. Now nothing more is left to be done in the instant case. Otherwise also, this Court is left with no other alternative, but to allow the writ petition and direct the

learned trial court to take the affidavits on record and afford an opportunity to the respondent-defendant to cross-examine him.

With the aforesaid observations, the writ petition stands disposed of.
