Heard learned counsel for the parties.

The submission of the learned counsel for the

appellant is that the learned trial Court has passed an order of injunction restraining the appellant, who is in possession to maintain the status-quo and not to transfer the property in dispute to any third party.

Learned counsel for the appellant has contended that so far as the above order is concerned the appellant has no grievance against the same. However, he submits that the respondent also should be restrained from creating any third party interest in the property in dispute and to maintain the status-quo during pendency of the suit.

Learned counsel appearing for the respondentplaintiff submits that he has no objection, if the prayer made by the learned counsel for the appellant is allowed.

In the facts and circumstances, the order passed by the learned trial Court is modified and it is further directed that both the appellant and the respondent shall maintain the status-quo with regard to the property in dispute as also shall not create any third party interest in the same during the pendency of the suit.

Subject to the above, the miscellaneous appeal and the stay application stand disposed of.
