In the facts and circumstances, therefore, the present writ petition is covered by the decision of this Court in R.S.R.T.C. & Another V/s. Ramesh Kumar Sharma & Ors. reported in 2008 WLC 607 decided on 27.02.2008 and the application under Order 7 Rule 11 CPC has rightly been dismissed.
