It is contended by both the learned counsel for the parties that this matter may be disposed of in terms of the order passed in identical writ petition being SB Civil Writ Petition No. 1676/2006 (M/s Ketki Polytex Private Limited Vs. State of Raj. & Ors.), decided on 13.9.2006 wherein it was ordered as follows :

“It is urged that the State Government may consider the petitioner's case for relaxing the breach of conditions on its own merit. The request made by the petitioner appears to be just and reasonable. Therefore, the writ petition is disposed off with the direction that the petitioner will be at liberty to make an

application to the State Government within a period of four weeks from the date of this order, if not already made for relaxation of the breach of conditions. The State Government will decide the application submitted by the petitioner within a period of two months thereafter, in accordance with the notification. Till the application preferred by the petitioner is disposed of by the State Govt. no coercive proceedings shall be adopted for recovery in pursuance of the impugned order in the writ petition”
