As per the observations made in the order dated 30.03.2026, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte .

The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/759/2025, titled ‘Sanjay Kumar Vs. Preeti Rani’, filed by the

respondent-husband, pending in the Family Court, Ambala and she seeks transfer of the same to the Court of competent jurisdiction at Karnal.

It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 02.12.2022. One daughter was born from the said wedlock on 05.07.2025, who is presently in the care and custody of the applicant. On account of the matrimonial dispute, the parties are residing separate. Also, counsel submits that an application has been filed by the applicant, for initiation of criminal proceedings against the respondent, before police authorities at Karnal and the same is still pending inquiry. The applicant is not having any source of earning and is dependent upon her parental family. In the given circumstances, it is submitted that it is difficult for the applicant, to commute a distance of about 80 kms., to defend the petition under Section 9 of the Hindu Marriage Act.

In view of the aforesaid fact situation, more particularly, considering about the applicant to be taking care of the toddler, while she herself is not having any source of earning and above it, considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/759/2025, titled ‘Sanjay Kumar Vs. Preeti Rani’, filed by the respondent-husband, stands transferred from the Family Court, Ambala, to the Court of competent jurisdiction at Karnal. The requisite record of the aforesaid case be sent by the Family Court, Ambala, to the District and Sessions Judge, Karnal.
