The present writ petition ha s been filed by the petitioners under Arti c les 226/227 of the Constitutio n of India for issuance of a writ in the nat u re of Mandamus directing the respondents to revise the pay scale of th e petitioners as per 7^th Pay Scale along with other allowances as given to r e gular employees/Haryana School Shiksha Parishad Priyojna Employee s with whom the pay scale of t h e petitioners was equated; with retrospecti v e effect in view of judgmen t dated 26.05.2026 (Annexure P-14) passed by a co-ordinate Bench of t h is Court in CWP-29110-2025 titled as ‘Priyawart and others vs. State o f Haryana and others along with other conn e cted petitions’.

Learned counsel for the peti t ioners, inter alia, submits that although i n itial appointments of all of th e 289 petitioners herein was on contractua l basis, however, all the petitioners have been working for over a decade. It is submitted that the case of th e petitioners is fully covered by the ratio of judgment dated 26.05.2026 ( A nnexure P-14) rendered by a co-ordinat e Bench of this Court wherein t h e persons similar situate as the

petitioners , have been held entitled to revised pay scale under the 7^th Pay Scale.

Ms. Ruchi Sekhri, Addl. A. G ., Haryana, accepts notice on behalf of respondents No.1 to 6-State; w hereas Mr. Vipul Aggarwal, Senior Pa n el Counsel-UOI who is prese n t in Court accepts notice on behalf of r e spondents No. 7 to 9.

Learned counsel for respo n dents No. 1 to 6-State on instruction s submits that the respondent- S tate is in the process of filing Letters Pa t ent Appeal against the judgme n t dated 26.05.2026 (Annexure P-14). It is also pointed out that the petiti o ners are contractual employees and are seeking the above said bene fi t of revised pay scale with retrospecti v e effect.

At this stage, learned counsel for the petitioners submits that the petitio n ers have already submitted a r e presentation dated 01.06.2026 (Annexure P-13). It is prayed that presen t writ petition be also treated as a represen t ation on behalf of the petitione r s and the same may be ordered to be disp o sed of by the concerned Competent Authority/respondent No. 3-Director , National Health Mission (Stat e Health Mission), Haryana, by passing a S peaking Order in a time bound m anner. 7. Without commenting upon th e merits of the case, the present petition is disposed of, with a directio n to the concerned Competent Authority/ r espondent No. 3-Director, N a tional Health Mission (State Health M ission), Haryana, to treat t h e present writ petition as representa t ion on behalf of the petitioners; and decide the same by passing

It is made clear that this Cour t has not expressed any opinion on the en t itlement of the petitioners to the claimed benefit, and the Competen t Authority shall take an inde p endent decision in accordance with the a p plicable rules and regulations.
