The appellant-plaintiffs are in second appeal against the judgments and decrees of both the Courts below whereby the suit of the plaintiffs w as decreed, however, the r e lief qua declaration seeking annulment of sale deed No. 66 dated 13.04.2011 was declined.

The matter pertains to the ye a r 2020 and notice is yet to be issued in t h e same.

Perusal of the order-sheet(s) reveals that earlier this second appeal wa s dismissed for non-prosecutio n by a co-ordinate Bench vide order date d 14.03.2023, on account of n o n-appearance on behalf of the appellants. Subsequently, upon an applic a tion moved by the appellants, the same w as restored vide order dated 19. 0 5.2023. Thereafter, the present appeal wa s listed for hearing 08 times i . e. on 17.07.2023, 17.08.2023, 13.12.202 3 , 12.02.2024, 21.02.2024, 11.07.2024, 05.12.2024 and 22.04.202 5 , but the same was adjourned e ither at the request of learned counsel fo r the appellants or on account o f non-appearance on behalf of the appell a nts. On the last date of hearin g i.e. 22.04.2025, the case was adjourned at the written request of learne d counsel for the appellants and

last oppor t unity was granted to learned counsel for the appellants to address ar g uments.

Today, a request for hearin g of the present case through Video Co n ferencing has been made by lea r ned counsel for the appellants. However, even in the second round of h e aring, learned counsel for the appellants h as not joined the proceedings t h rough video conferencing.

A bare reading of the above facts shows that the appellants have exhi b ited an utterly casual attitude in their pursuit of the present litigation. I t is to be appreciated that ve r y valuable public time of the Court has been expended in affording op p ortunities to the appellants in the interes t of justice. On the other hand, the appellants have adopted an utterly cas u al and careless approach. It is clear that neither the appellants nor their counsel are seriously interested in pursuing the present matter. Thus, this C ourt is left with no other optio n except to dismiss the same for non-prose c ution.

Ordered accordingly.
