The appellants-plaintiffs h a ve filed the present appeal against t h e concurrent findings of the le a rned Courts below whereby the suit f iled by them for permanent i n junction with consequential relief of declaration has been partly d e creed and partly dismissed. The resp o ndent-defendant Piare Lal was permanently restrained from interferin g or dispossessing the plaintif f from the house in question and rega r ding the rests of the claim of th e appellants-plaintiffs, suit of the appel l ants-plaintiffs was dismissed.

On the last date of hearing i.e. 03.3.2025 there was no represent a tion on behalf of appellants. A ccordingly, the co-ordinate Bench h a d directed that the appellants be intimated about the next date.

As per office report, notice i ssued to appellants No.1 and 2 has b e en received back with the r e port ‘not residing at given address’ and notice issued to appellant s No.3 and 4 received back unserved due to incomplete address.

In the aforesaid premise, iss u ance of fresh notice to the appellant s would be a futile exercise. I t appears that due to sheer long pen d ency of the present appeal before this Court for a period of more tha n 26 years, the appellants have lost interest in pursuing the same, as n o attempt has been made by t h em to contact their counsel or to eng a ge a new counsel.

Be that as it may, in view of the foregoing circumstances, the insta n t appeal is disposed of , with liberty to the appellants, to move an appropriate application within a period of 02 months from today for reviving the same, if so, advise d .
