Jaswinder Singh Alias Bhagat and Ors. Vs State of Punjab and Ors.

Instant petition has been filed by the petitioners, under Section 528 of the BNSS, 2023 (earlier Section 482 Cr.P.C.), seeking quashing of the below detailed First Information Report (FIR), and all the consequential proceedings arising therefrom, on the basis of the compromise dated 14.12.2024 (Annexure P- 4), effected between the parties.

all the consequential proceedings arising therefrom, on the basis of the compromise dated 14.12.2024 (Annexure P-4), effected between the parties.

2. Learned counsel for the petitioners submits that all the parties to the dispute, already arrayed as parties in the present petition, have amicably resolved their dispute through compromise dated 14.12.2024 (Annexure P-4). Therefore, if proceedings arising from the aforementioned FIR, and all the consequential proceedings arising therefrom, are quashed, all the parties and their family members will be able to live their lives peacefully.

Learned counsel for the petitioners also submits that petitioner Nos.5 and 6 are stated to be inside jail, and therefore, he prays that their statements be recorded, either by producing them by the Jail Authorities before the Court, or through Video Conferencing mode.

3. Notice of motion.

4. On asking of the Court, learned State counsel, who is present in the Court, accepts notice on behalf of the respondent-State.

5. Ms. Harpreet Kaur, Advocate, appears on behalf of respondent Nos.2 to 4, and admits execution of the compromise (Annexure P-4).

The affected parties are directed to appear before the learned Trial Court/Illaqa Magistrate, on or before 24.02.2025 or on any other date convenient to the Court, for getting their respective statements recorded with regard to the compromise. Thereupon, the concerned Court shall submit a detailed report, containing the information on the following points, along with copies of the statements to this Court, on or before the adjourned date:-

In regard to the contentions addressed by counsel for the petitioners, it is made clear that either Court of learned Magistrate, which has to record the statement of the parties, would examine the situation in totality, and thereupon, if it finds that the accused, who are there inside jail, are required to be produced before the Court for the purpose of recording the statement, necessary directions would be issued to the Jail Authorities in that regard, and thereupon, the statement be recorded on production of the such accused.

9. It is also made clear that if the Court considers it fit, the statements could be recorded through Video Conferencing Mode also, subject to satisfying himself/herself about the proper identification of the accused, who are already in custody.

10. Reply by the respondent-State, if any, be filed on or before the next date of hearing.”

As per the report dated 19.03.2025, received from the Court of the Judicial Magistrate First Class, Faridkot, it is stated that there are two accused,

namely Gulab Singh and Sikander Singh @ Nanni, who were in custody in another case and were produced before the Court. Both of them recorded their joint statements, stating therein that a compromise could not be effected between the parties.

Even today there is no representation on behalf of the petitioners as well as the respondents.

Hence, the instant petition is dismissed for want of prosecution.
