Present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, inter alia, for directing respondent No.3 to transfer the investigation from respondent No.5 to any other Officer of higher rank (HPS level) in FIR No.0577 dated 18.11.2024, under Sections 324(4), 326(g) of the Bharatiya Nyaya Sanhita, 2023, registered at Police Station Kurukshetra University, District Kurukshetra.

(2) Although, there is no formal notice of motion, but learned State Counsel apprised that after examining the allegations, Untraced Report has already been prepared by the police. Apart that, learned State Counsel produced copies of FSL Report, Madhuban as well as Crime Scene Inspection Report dated 18.11.2024, which are taken on record as Mark ‘X’(colly.). Registry to tag the same at appropriate place.

(3) In view of the above factual position, learned Counsel for the petitioner, on instructions, does not press the petition any further “at this stage”.
