By way of filing the present r evision petition, the petitioner/ tenants as s ail the concurrent judgments o f both the Authorities below whereby t h e eviction petition filed by th e respondent-landlord has been allowed.

Learned Senior Counsel for petitioner/tenants has assailed the impu g ned judgments on the gro u nd of concealment that the responden t -landlord had failed to disclose the other shops owned by him in the vici n ity of the demised shop(s). Ho w ever, it is admitted by learned Senior Co u nsel for the petitioners that in t he replication, the respondentlandlord h a d mentioned about all the shops owned by him. responden t -landlord in respect of the sa m e demised premises seeking eviction o f the petitioners and on the sam e cause of action. However, it is proven on record that the said rent petitio n s have been filed by the father of the pre s ent respondent-landlord. Acco r dingly, after arguing for some time whe n this Court is not inclined to i n terfere in the findings of fact recorded b y learned Appellate Authorit y , learned Senior Counsel on instruction s submits that six months’ t ime may be granted to the petitioners to vacate the demised shop/pre m ises.

In view of the facts notice d above, this petition is being disposed of with the direction that the petitioners will hand over physical, peaceful a nd vacant possession of the d emised premises/shop to the responden t s on or before 19.06.2026, fail i ng which this revision petition shall be de e med to be dismissed without a n y further orders.

The petitioners will also fur n ish an undertaking along with one surety bond before Rent Controller c o ncerned within a period of 04 weeks fro m today that they will handover vacant position, as undertaken above by t h em.
