The present revision petition h as been filed by the petitionertenant ag a inst the judgment dated 26.1 1 .2024 passed by the learned Appellate Authority, Ludhiana, where b y the appeal filed by the responden t -landlord against the order da t ed 03.10.2018, passed by the learned R e nt Controller, Khanna, was allowed and eviction of the petitioner h as been ordered from the demi s ed shop on the ground of nonpayment of rent and personal bona fide r equirement of the respondentlandlord.

After arguing for some time, when this Court is not inclined to interfer e in the matter on merits, learn e d counsel for the petitioner on instruction s from the petitioner who is pre s ent in Court prays that he may be granted 06 months time to vacate the d emised premises/shop. In fact, on the la s t date of hearing i.e. 02.09. 2 025, learned counsel for the petitioner- t enant had sought time to get necessary instructions in this regard.

Further, learned counsel for t h e petitioner-tenant submits that the respon d ent-landlord has already filed t he Execution Petition which is now pend i ng adjudication for 18.09.202 5 . It is also informed that the petitioner- t enant is in arrears of rent to the tune of ₹1,44,000/(approxim a tely) and in order to show his b ona fides , the petitioner tenant has broug h t a demand draft No. 580484 d ated 28.08.2025 amounting to ₹1,00,000/ - , in favour of respondent-la n dlord. Photocopy of the said demand dr a ft is taken on record.

On instructions from the peti t ioner who is present in person in Court, l e arned counsel undertakes that t he petitioner-tenant shall hand over the a foresaid demand draft to the r espondent-landlord before the Executing Court on the next date of hearin g i.e. 18.09.2025.

Keeping in mind the entirety of the facts and circumstances of the case and the aforesaid undertaking g iven by learned counsel for the petitioner- t enant, the present petition is disposed of without issuing Notice of M otion to the respondent-landlo r d as that will only further delay the matter; and the petitioner-tenant is hereby directed to vacate the demised premises/shop in 06 months fr o m today and will hand over physical, p eaceful and vacant possession o f the demised premises/shop to the respon d ent-landlord on or before 10.0 3 .2026; and will deposit all the arrears of r ent, if any, before the learned E x ecuting Court on the next date of hearing i.e. 18.09.2025.
