The present Contempt Pet i tion has been filed alleging violation o f the order dated 13.09.2024 ( A nnexure P-1) passed in CWP5540-2016, titled as ‘Parween Kumar and others vs. State of Haryana and others’.

It is to be noted that the gri e vance raised by the petitioner along with co-petitioners in the aforesaid w rit petition (CWP-5540-2016) was that t h e petitioners who are working a s Casualty Medical Officers on regular basis are also entitled for the s ame pay scale as was being extended to the other Medical Office r s who are working in the Governme n t of Haryana. Accordingly, the said writ petition was disposed of by the Writ Court vide order dated 1 9 .03.2024 (Annexure P-4) with the following direction:-

“4. Learned State counsel submits that in case, the issue with regard to grant of sa m e pay-scale to the Causuality Medical Officers as given to the Medical Officers, as

recommended by responde n t No. 6, is still pending consideration with the auth o rities concerned, appropriate decision will be taken within a period of 08 weeks from the date of receipt certified co p y of this order and the final decision taken by the Gov e rnment, will be informed to respondent No. 6, accordingl y .”

Learned counsel for the p e titioner submits that in noncomplianc e of the said order dated 1 9 .03.2024 (Annexure P-1) the responden t s have not passed any speaking o rder.

Learned counsel for the resp o ndents vehemently opposes the submissio n s of learned counsel for the petitioner and states that in pursuance of the Writ Court order dated 1 9.03.2024 (Annexure P-1), the post of Casualty Medical Officer held by the petitioner was merged into the post o f General Duty Medical Office r vide order dated 12.09.2024, annexed with the compliance report (Ann e xure P-5, at page No. 32 of the paper-boo k ); wherafter the same pay s c ale as that of General Duty Medical O fficer, was accorded to the petitioner vide order dated 07.11.202 5 (Annexure R-2/3). It is, therefore, submitted that nomenclat u re of the post now held by t h e petitioner and other Medical Officer ha s also been made at par, as also the pay-scales are also made at par. There f ore, the grievance of the petitio n er has been duly redressed. 5. At this stage, learned counse l for the petitioner submits that the said p ay-scale has been granted t o the petitioner only w.e.f. 12.09.202 4 i.e. the date on which 02 po s ts were merged. Further, it is submitted t hat in terms of order Dated 12. 0 9.2024 (Annexure P-7) case of the petitio n er was forwarded by the Fina n ce Department, Government of Haryana t o the Additional Chief Secreta r y to Government of Haryana, Medical E d ucation and Research Departm e nt.
