The plaintiffs are in second a ppeal against the concurrent judgments and decrees of the learned C o urts below whereby the suit filed by the plaintiffs for possession and declaration has been dismisse d by both the learned Courts bel o w.

The present appeal is of the year 2020 and has been filed alongwit h an application for condonatio n of delay of 232 days in refiling the appeal.

Order sheets shows that n o tice of motion is yet to be issued in the matter as the same has bee n adjourned repeatedly either at reque s t or due to non-appearance of learned counsel for the appellant s . On the last four continuous d a tes i.e. 12.9.2024, 24.9.2024, 13.11.20 2 4 and 04.3.2025 there was no representation on behalf of appellant s . Even today there is no r epresentation on behalf of appellant s .

A bare reading of the a b ove facts shows that the appellant s have exhibited an utterly cas u al attitude in the pursuit of the prese n t litigation. It is to be apprecia t ed that very valuable public time of t h e Court has been expended in a ffording opportunities to the appellant s in the interest of justice. On t h e other hand, the appellants have ado p ted an utterly casual and carel e ss approach. It is clear that neither t h e appellants nor their counse l are seriously interested in pursuing the present matter. Thus, this Court is left with no other option except to dismiss the same for no n -prosecution.
