Court:-
“ Learned counsel for the appellant states that he is unable to contact the appellant. A registered le�er sent by him has also been received back with the report “Refused to accept”. The no ce issued to the appellant by ordinary process was received back with the report “Duly Served”. However, the appellant has not contact the counsel. The respondent in the present case is also stated to have died and no applica on for impleading his legal representa ves has been filed ll date. Since the learned counsel for the appellant is unable to get in touch with the appellant, the main case be listed for hearing as per its turn.
IOIN for service stands disposed off.”
Today again, Mr. Lalit Garg, Advocate informs that the appellant has not
contacted him.
In the afore-said circumstances, when appellant is no longer intersted in pursuing the appeal, the present appeal is dismissed in default for want of prosecu+on.
