and Balbir Singh i.e. respondent No.4. Their character verifications were got conducted from the concerned police station. The Tehsildar Garshankar after hearing both the candidates, recommended the name of Surjit Singh to the Sub Divisional Magistrate, Garshankar for the appointment of lambardar. Agreeing with the same, Sub Divisional Magistrate recommended the name of Surjit Singh i.e. the petitioner to the Collector. On comparison of their inter se merits, Surjit Singh i.e. the petitioner was found to be 48 years of age and he was 6th class pass by qualification. Besides this, he owned 10 kanal of land. On the other hand, Balbir Singh i.e. respondent No.4 was found to be 60 years of age and he was BA part II pass by qualification. Besides this he owned 20 kanal of land. On the evaluation of inter se merits of both the candidates, the learned Collector appointed Surjit Singh i.e. the petitioner as lambardar of the village vide order dated 01.10.2019. Being aggrieved by the same, respondent No.4 assailed the same by way of filing the appeal before the learned Commissioner, Jalandhar Division, Jalandhar. The learned Commissioner, on hearing both the sides and perusing the record, found the order passed by the District Collector to be perverse and thus, set aside the same. Learned Commissioner has remanded the case to the District Collector with a direction to pass a fresh order vide his order dated 29.09.2021. Being aggrieved by the same, the petitioner filed an appeal under Section 13 of the Punjab Land Revenue Act, 1887 before the learned Financial Commissioner.
