Prayer in this petition filed u n der Section 482 Cr.P.C. is for issuance o f directions to transfer the inv e stigation of case FIR No. 290 dated 27.1 2 .2023 registered under Sectio n s 304-B, 316, 323, 34 IPC at Police St a tion Panjokhra, District A m bala, to Central Bureau of Investigati o n (CBI) or to form a Special I n vestigation Team headed by an officer not below the rank of Superintendent of Police, for fair and proper investigati o n in the matter.
At the very outset, on inst r uctions from SI Gian Chand, learned c o unsel for the State submits t hat instant petition has been rendered i n fructuous as, after completion of investigation, the police has prepared a cancellation report in the matte r on 06.07.2024 and the same is likely to b e presented before the learned t r ial Court within a period of 04 weeks fro m today.
Learned counsel for the p e titioner has not disputed the aforesaid s ubmissions of learned counsel for the State and submits that, the instant petition has been rendered infr u ctuous and may be disposed of, as such.
