The pe��oner prays for regular bail by way of this pe��on filed under Sec�on 483 of the Bhara�ya Nagarik Suraksha Sanhita, 2023 (old Sec�on 439 Cr.P.C.) in case FIR No.58 dated 18.05.2023 under Sec�ons 406, 420, 467, 468, 471 IPC; Sec�on 13 of Punjab Preven�on of Human Smuggling Act, 2014 and Sec�on 24 of Immigra�on Act, 1983 registered at Police Sta�on Sadar Pathankot, District Pathankot.

It is his third bail pe��on for this purpose. The earlier two pe��ons bearing No.CRM-M-34654-2023 and CRM-M-4267-2024 were dismissed as withdrawn vide order dated 30.10.2023 and 03.05.2024 respec�vely.

FIR was lodged on the complaint of Kulwant, who approached the police along with Loka Ram, Subhash Chander and Dyal Chand to take ac�on against Jasbir singh (pe��oner), his brother-in-law Anil Jasro�a and sister (unknown) wife of Anil. It was alleged that respec�ve sons of the complainant namely - Vishal Bhagat, Arun Kumar, Ni�n and Pradeep Kumar are educated but unemployed. Pe��oner Jasbir contacted them and

assured to send their sons to Argen�na. He took ₹5,00,000/- each from all four of them i.e. totaling ₹20,00,000/-. The amount was taken in cash and also through bank transac�on. Amount of ₹5,00,000/- was paid in the bank account of the pe��oner Jasbir. It was alleged further that brother-in-law and sister of the pe��oner kept on giving assurance to send the sons of the complainant to abroad but instead of providing original VISA, they sent the VISA through WhatsApp and on inquiries, the same were found to be forged. The complainants requested the accused several �mes to return the money. On 17.04.2023, they were called at their house, where Subhash Chander was confined in the room and was given bea�ngs with threats of dire consequences.

FIR was registered. During inves�ga�on, more complaints poured in, as accused- pe��oner was alleged to have taken ₹2,00,000/- in cash along with original passport of Pushpa Devi. Another complaint was made by Kamal Kishor, who was duped by the pe��oner of ₹3,10,000/- on pretext of seEling him in Cambodia. It was further found during inves�ga�on that as many as five other FIRs were registered against the pe��oner at various police sta�on, as he had cheated several people also.

Pe��oner was arrested on 18.05.2023. During search of his car, a black bag was recovered, containing 25 passports of different persons. It was found during inves�ga�on that pe��oner was involved in serious offences of duping huge amount from the various people on the pretext of sending them abroad.

It is contended by learned counsel that pe��oner has been falsely implicated; that pe��oner is in custody for the last more than 01 year 06 months; that final report under Sec�on 173 Cr.P.C. has already been filed; that trial is likely to take long �me to conclude and so, he be allowed bail.

Strongly opposing the bail pe��on, learned State counsel has drawn aEen�on towards the involvement of the pe��oner in numerous other cases, all of similar nature. It is also pointed out that on the last date of hearing, learned counsel for the pe��oner had sought adjournment to obtain instruc�ons as to whether pe��oner was ready to return the original documents of the complainant and the money received by him through bank transac�on. However, today it has been informed by counsel for the pe��oner that pe��oner is not in a posi�on to return the money. Learned State counsel has prayed for dismissal of the earlier bail pe��on.

I have considered submissions of both the sides and perused the record.

As is apparent from the status report, pe��oner is involved in duping numerous people of their hard earned money on the pretext of sending them/their wards abroad. 25 passports of different persons have been found from his possession. Fake VISAs were sent to the complainants. He is involved in numerous cases of similar nature.

10 Having regard to all the aforesaid facts and circumstances, but without commen�ng anything further on the merits of the case, this Court is not inclined to grant benefit of bail to the pe��oner.
