Present application und e r Section 378(4) Cr.P.C. is file d seeking lea v e to file appeal against orde r dated 22.09.2016 passed b y learned Judi c ial Magistrate, 1st Class, Mog a , whereby in a complaint cas e filed by the applicant under Sections 457, 3 54, 342, 382, 380, 427 and 3 4 IPC, the respondents/accused have been discharged. 2. Learned counsel for the a pplicant inter alia submits tha t the accused/respondents herein have be e n wrongly discharged by th e learned trial Court as the applicant had ap p eared as her own witness and recorded h e r statement in support of he r case. The applicant had als o produced h e r father as a witness whos e statement was recorded o n 27.08.2012 (Annexure A7) supporting the c a se of the applicant. Even Hea d Constable G urpreet Singh was produced as a witness who had, vid e statement d a ted 09.09.2015 (Annexure A8), supported the applicant’s case. It is submitted that accordingly, in view of this voluminous evidenc e produced b y the applicant before t h e learned trial Court, th e accused/res p ondents could not have been d ischarged. It is contended tha t the accused / respondents at least ought to have been summoned. It i s submitted t h at the learned Magistrate ha s failed to appreciate that ver y SUNENA serious allegations have been made by the applicant against th e 2024.08.12 11:45 I attest to the accuracy and authenticity of this document
