Prayer in this transfer petitio n filed under Section 407 read with Secti o n 482 Cr.P.C. is for transfer o f all the three criminal cases i.e. (i) COMI / 728 dated 29.09.2018 under Sections 498-A and 406; (ii) COMA N o. 305/2015 dated 24.04.20 1 5 under Section 12 of the Protection of Women from Domestic Vi o lence Act, 2005 both filed by responden t No. 2; and (iii) COMA/152 / 2018 dated 04.04.2018 under Sections 12[1(b)][2] of Passport Act an d Sections 420, 463, 464, 467, 468, 470- 4 74, 476 and 34 IPC filed by pe t itioner No. 1 (Annexure P-1 to P-3, resp e ctively) pending in various Courts at Sessions Division, Jalandhar to the Courts of competent j u risdiction at Patiala, Mohali, Chandigar h or any other Court of compete n t jurisdiction.

Perusal of the order sheets sh o ws that notice of motion in the present ca s e was issued by a co-ordinate B ench of this Court vide order dated 06.0 4 .2021 and the petitioners were a lso directed to bring a demand draft of R s.15,000/- favouring responde n t/wife, towards the litigation expenses.

After arguing for some time, when this Court is not inclined to interfer e in the matter keeping in vie w the fact that notice of motion order date d 06.04.2021, has not been com p lied with by the petitioners till date, learn e d counsel for the petitioners su b mits that she may be permitted to withdra w the present petition.
