(1) This Letters Patent Appeal is directed against the order dated 05.11.2015 whereby learned Single Judge has very aptly resolved the controversy with regard to the construction of booths in place of temporary platforms/sheds raised in Sector 15, Chandigarh for the sale of second-hand books.

(2) Learned Single Judge has got the dispute resolved by conducting draw of lots in the Court itself so that the proposal achieves its object of improving the working conditions, quality of life, ambience and would also be in conformity with the concept and building byelaws of ‘City Beautiful’.

(3) The order passed by the learned Single Judge, so far as the merits of the case are concerned, thus deserves approval and calls for no interference.

(4) As regards the unfortunate incident that happened at 3.00 p.m. and which constrained the learned Single Judge to make certain observations against Sh. APS Shergill Advocate, we have heard Sh. Shergill very passionately. We have no reason to doubt that the trivial issue would be given a decent burial no sooner Mr. Shergill will move an application for expunction of those remarks and the learned Single Judge will surely show his magnanimity. We request the learned Single Judge that having regard to the standing of Sh. Shergill and the fact that he is regretful for the avoidable events that took place inside the courtroom, the remarks which are likely to have adverse effect on Sh. Shergill’s future prospects may be expunged.
