Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Shashi, who has been booked for having committed the offences punishable under Sections 323, 324, 326 and 341 read with Section 34, IPC, in a case arising out of FIR No.754, dated 18.08.2014, registered at Police Station, Chandani Bagh, Panipat, District Panipat.
Learned counsel contends that initially the case was registered for the offences punishable under Sections 323, 324 and 341 read with Section 34, IPC, and thereafter the petitioner was arrested and released on bail; after some time Section 326, IPC, was added and the petitioner was once again arrested on

13.10.2014 and since then he is behind the bars; all the offences for which the petitioner has been booked are triable by learned Judicial Magistrate First Class; the petitioner is neither required nor involved in any other case; and the injured who had alleged to have received the injuries has already been discharged from the hospital on 27.08.2014.
Learned counsel for the State, on instructions from ASI Suresh Kumar of Police Post Kishanpura, Police Station, Chandani Bagh, Panipat, has not controverted the submissions made by the learned counsel for the petitioner.
Keeping in view the totality of the facts and circumstances of the present petition, the same is allowed. Petitioner-Shashi son of Ramphal, resident of Gotam School Wali Gali, Kishanpura, Panipat, District Panipat, is ordered to be released on bail during pendency of the trial of the present case subject to his furnishing bond in the sum of `1,00,000/- with two sureties in the like amount to the satisfaction of learned trial Court.
