The present writ petition was ordered to be listed after the decision of CWP No. 12099 of 1993. The said case was dismissed for nonprosecution on 07.01.2010. The relief claimed is for promotion to the rank of Sub Inspector w.e.f. 18.07.1981 on account of the fact that the petitioner stood acquitted by the Special Judge on 28.05.1985.
Perusal of the writ petition would go on to show that the petitioner superannuated on 28.02.1994 (Annexure P-6) and his grouse that he was not promoted on account of acquittal way back on 28.05.1985 was not raised during his service period. The present writ petition was only filed at the fag end and just prior to his retirement/superannuation.
None has put in appearance on behalf of the petitioner in spite of the fact that letter was issued to counsel for the petitioner. The office has reported that the counsel is an outside counsel. It is apparent that the petitioner has lost interest in the present litigation.
Accordingly, the present writ petition is dismissed for want of
prosecution.
