Learned counsel for respondent No.4 states that his client is present but he does not want to participate in the bidding process in Court as, according to him, he has already succeeded.
The aforesaid aspect has been examined by us in our order dated 18.12.2013 where we had noted that both the bids were at par and instead of going by the toss of the coin, an inter se bidding ought to have taken place. The petitioner, in this petition, itself offered 50,000/ - more per month over the bid of 41 lakhs. Learned counsel for the petitioner submits that his client is further willing to go up by another 50,000/ - per month, i.e., by 1 lakh over the last bid, m aking it ` 42 lakhs per month.
In view of the aforesaid, by consent of learned counsel for respondents No.1 to 3, the bid of the petitioner at ` 42 lakhs is accepted
