The petitioner impugns the orders dated 11.04.2012 and 04.01.2013 passed under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961 (hereinafter referred to as 'the Act'). The first order pertains to petitioner's eviction on a petition filed by the Gram Panchayat and vide the subsequent order, his appeal against the eviction order has been dismissed. In summary proceedings, both the authorities have held that at the time of consolidation, the land was specifically earmarked and reserved for roori and pond , i.e., for public purpose.

After arguing the case for some time, learned counsel for the petitioner submits that she may be permitted to withdraw this writ petition with liberty to file a declaratory petition under Section 11 of the Act to enable the petitioner to establish his title qua the land in dispute.

In the light of the above-mentioned prayer, the writ petition is dismissed as withdrawn with liberty to the petitioner to file the above-stated petition.

Having regard to the attending circumstances, it is directed that the parties shall maintain status-quo for a period of three weeks. Thereafter, the petitioner shall be at liberty to make out a case for grant of further ad-interim stay before the Collector.
