Petitioner has filed this petition seeking quashing of the order dated 3.9.2012 (Annexure P-11) whereby release of benefits admissible under Assured Career Progression Scheme, 1998 were kept pending for 15 years as the pay scale of the petitioner had not been regularized.

On 22.1.2014, following order was passed by this

“The petitioner who is working as Law Officer with respondent No. 3 i.e. Punjab Backward Classes Land Development and Finance Corporation, was granted benefit of pay scale of _. 800-1400 from the date he assumed the charge as Legal Assistant i.e. 17.01.1983 and revised pay scale of_ 2000-3500 w.e.f. 1.1.1986 vide order dated 17.01.1997 (Annexure P-4) passed by

Executive Director, BACKFINCO. It is claimed that the said order has been approved by Welfare Ministry concerned vide noting dated 20.02.2002 (Annexure P-13) but till date, the benefit of the said order has not been extended.

On the last date of hearing, learned State counsel had prayed for time to seek instructions as to why the petitioner's case had been singled out for denial of benefits which have been given to others.

At the time of hearing today, learned State counsel on instructions from Sh. Darshan Singh, Superintendent office of respondent No. 3 states that the matter is pending before the Directorate of Welfare of Scheduled Castes and Backward Classes for being forwarded to the Department of Finance for necessary approval. He prays for a short adjournment for taking final decision.

It is, however, clarified that if the required decision is not taken before the next date of hearing by passing a speaking order, the Secretary to Government of Punjab Department of Welfare of Scheduled Castes and Backward Classes and the Secretary to Government of Punjab, Department of Finance shall be present in Court for assistance.

It is also clarified that no exemption from personal appearance on their behalf shall be entertained.”
