Brief factual background of the case is that respondent no. 4 moved an application before Divisional Canal Officer for sanctioning of water course AB running through rectangle/Killa Nos. 421/6-7-8. The authority after verifying all facts and affording opportunity of hearing to the parties, allowed the application and sanctioned water course AB running through Rect./Killa No. 421//6-7-8 on the Northern side with a width of two karams, on compensation basis. Aggrieved, petitioner preferred appeal before the Superintending Canal officer. Same was, however, dismissed vide order 07.01.2013. Order was unsuccessfully challenged before the Chief Canal Officer. I find no infirmity with the orders passed. It is evident that water course AB has been running through Rect./Killa No. 421//6-7-8 for the last many years and respondents are irrigating their fields from this water course. Said water course was dismantled by the petitioner which was got restored by the order of SDCO, Ellenabad. In order that petitioner may not dismantle this water course AB again, respondent no. 4 applied for sanction of lined water course on compensation basis. The authority accepted the prayer. In my considered view canal authorities have taken a considered decision after hearing both the parties. Under the circumstances, there is no ground to interfere in writ jurisdiction. Dismissed.
